Chapter 1 General
SC La Framboise Blanche SRL, Bucharest, 5, Delinesti str, Romania, email@example.com, the owner of the brand “Framboise” runs an online shop under the internet address www.framboise.com.ro (hereinafter called “website”). All orders placed by you via the website and our deliveries and services are exclusively subject to the following general terms and conditions, in the version that is valid at the time of the order. We do not accept conflicting terms and conditions of the customer unless we have agreed to their validity in writing.
Chapter 2 Property – Copyright & Trademark
SC La Framboise Blanche SRL is the owner of the web site Framboise.com.ro and its contents. This includes, but is not limited to, the documentation, images, characters, design and format scripts. The material included in the web site Framboise.com.ro is protected by copyright.
This website is for your personal non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any Content, software, products, or services contained within this Site. You may not use this Site, or any of its Content, to further any commercial purpose, including any advertising or advertising revenue generation activity.

Capter 3 Important Notes
3.1. The articles offered on www.framboise.com.ro are presented as digital photographs depicting the existing merchandise. Slight differences between the photographs and reality do not constitute a defect of the ordered merchandise.
3.2. All prices are listed in Euro. No extra shipping cost will be charged if not specified otherwise. The online paid transactions will be charged in EUR , as specified on the Euplatesc.ro website at checkout. The prices and payments in EUR are valid for deliveries in the countries specified on the website. We reserve the right not to accept orders from certain countries, if not listed in the list of countries specified at “free delivery” option.
3.3. Framboise is entitled to perform partial deliveries.
Chapter 4 Delivery and Shipment
4.1. Worldwide shipping is provided via different carriers. Framboise bears the risk of transportation.
4.2. The merchandise will be ready for shipment one day after your order was placed for the items available in stock or several days if they are not in stock. Upon dispatch, your parcel will arrive in 1 to 7 days, depending on the shipping method and the destination, unless it was agreed otherwise. The customer will accept the order if the timing is shorter that mentioned on the website.
Chapter 5 Payment
You may pay for your order at Framboise with any credit card or partially with coupon codes. The payments by card will be made in RON at the exchange rate of the ecommerce payment solution supplier: Euplatesc.ro http://www.euplatesc.ro/plati-online/index.php/support-base/general/aboutus.html
Chapter 6 Retention of Title
Framboise reserves the right to retain title and ownership of any and all articles supplied until such time as full payment has been received.
Chapter 7 Conclusion of Contract
7.1. A contract between you and Framboise shall come into effect upon placing an order on the website. By submitting the ordering form provided on our website, you make a binding offer to us to conclude the contract. Your order has been placed once you have entered all the information that is required for the ordering process, and subsequently sent us the ordering form by clicking “submit order”.
7.2. Framboise shall be entitled to reject an order placed by you without stating any reasons. This shall apply particularly in those cases, where there are well-founded suspicions that the ordered articles are to be sold to third parties on a commercial basis. If an order is rejected, the person who has submitted the order will be informed in written and, if she has already paid by card or bank transfer, the amount will be fully refunded.
Chapter 8 Saving of Contract
We save your ordering data. If you wish to have a hard copy of your order, you have the ability to print out the “order confirmation”. You will receive the order confirmation with all given data by email that may be printed out.

Chapter 10 Warranty
10.1 All products sold on this website are brand new. Before dispatch, all products are carefully examined in order for you to receive them in the best conditions. However, if you have any claims due to manufacturer defect, we will arrange to have your product replaced free of charge.
10.2 All products sold on this website have a 30 days guarantee period. Warranty applies only to products who were used according to their initial destination, who have no external flaws and are accompanied by an invoice emitted by SC La Framboise Blanche SRL.
In lack of a guarantee certificate, the invoice will be considered a warranty document.
Chapter 11 Return instructions
11.1 Right to return
The customers may return merchandise they have received within a period of 14 days. The period commences at the moment the customer has received the merchandise.
The returns can be assisted. For asistance, please contact us at firstname.lastname@example.org and we will arrange all the necessary details for the return.
We agree on one day/ hour pickup with one of our courriers.
If the pickup does not succeed by the fault of the customer, we will not arrange another pickup. The customer will arrange the return on his own and will pay for the delivery. The customer will bare the costs and the transportation risks of any return. The return shipment must be addressed to SC La Framboise Blanche SRL, 19 Tudor Arghezi, 2nd floor, Bucharest, Romania, 020942, unless otherwise agreed in writing between Framboise and the customer.
11.2 Consequences of a return
In case of an effective return any payments received or, if applicable, any benefits achieved by use of the goods must be returned by both parties. In the event that the goods have deteriorated or for use (i.e. benefits from use) that cannot be reimbursed fully or partially or only in an impaired condition, you will have to pay an appropriate compensation. You will only have to pay compensation for a deterioration of the goods or for any benefits achieved, if the use or the deterioration is the result of handling the merchandise in a way that exceeds the assessment of its attributes or functionality. “Assessment of attributes or functionality” is defined as testing and trying out the respective merchandise, as it is possible and common in a shop. Obligations with regard to the refund of payments must be met within 15 days. For you this period begins with the dispatch of the merchandise or the send date of the return request, for us with the receipt.
Please note that we can only accept returns from the country that the shipment was sent to. If the shipment was sent to France, for instance, we can only accept a return from France.
The costs of your order will be charged to your credit card or bank account. In case of a return, your relevant card or bank account will be credited. However, any losses that are caused by currency fluctuations will not be refunded.

Chapter 12 Privacy
12.1. All customer data are saved and processed by Framboise solely in accordance with the relevant data protection laws. In particular, personal data are being collected, saved, and used exclusively for the purpose of processing the order or with your explicit consent. Furthermore, addresses and ordering data are collected, processed and used for internal marketing purposes.
12.2. In case you would prefer your personal data not to be used and processed for internal marketing purposes, simply inform us by post or email at firstname.lastname@example.org. Please be aware, however, that this does not apply to the data that are necessary to process your order.
12.3. We do not forward personal data to third parties except with regard to subcontractors of Framboise that require the transfer of data to process the order.
12.4. Framboise is a personal data processor in course of attestation by the National Authority of Personal Data Surveillance (ANSPDCP).
Chapter 13 Choice of Law, Effectiveness
13.1 Romanian law shall apply.
13.2 In case that one or more provisions are invalid, the validity of the remaining provisions shall remain unaffected.
